Terms of service

The Terms of Service (WSU) are the rules and provisions that set out how the Host4Biz services may be used. Your use of our services is the subject of this document. Read it carefully and make sure you understand it and agree to all of its parts. Using the Host4Biz services means you agree to all of the terms.

Terms of service

Host4Biz provides hosting to individuals and companies all over the world. We have a duty to protect every one of our clients and to give them the best services we can. Users of our services are obliged to use them with «fair use» in mind — that is, to use the services and resources of the operator, Host4Biz, economically and as intended. The rules below are designed to assure our clients that Host4Biz services mean the highest quality. Please read this document carefully before placing an order and/or using the Host4Biz services.

Regulations

The Host4Biz hosting services agreement is a separate service contract between Host4Biz and all clients. Make sure you accept all the provisions not only of this document but of the agreement as a whole before registering for or using the Host4Biz services. Contact our sales team if you need clarification or further information.

Resource usage policy

The Host4Biz resource usage policy is an extension of the Terms of Service containing more detailed rules on the use of hosting accounts. Make sure they match your expectations and that you accept all the rules and terms before signing the agreement or before using the Host4Biz services. Content

All services provided by Host4Biz may be used only for lawful purposes. Transmitting, storing or presenting any content, data or material in breach of Polish law is prohibited. This includes, but is not limited to, copyrighted material, material we judge to be threatening or obscene, and material constituting a trade secret. The client agrees to indemnify and hold Host4Biz harmless against any claims arising from their use of a service that has a negative effect on them or on other people.

Note: pornography and sex are prohibited on every Host4Biz server. This also covers sites that may imply the publication of sexual content, and links to adult content located on external servers. It likewise covers sites that promote any illegal activity, and content that may be harmful to Host4Biz servers or to any other server on the internet. Links to such material are also prohibited. Contact our sales team if you need clarification or further information.

Examples of content Host4Biz does not accept:

  • pirated software;
  • pornography;
  • hacking and cracking;
  • warez and/or other copyrighted content such as MP3s;
  • material that is illegal under Polish law;
  • sites containing material, or links to material, that may be considered harmful or a threat to security — such as, but not limited to: information about the use of weapons, instructions for constructing explosives, or anything else that may be considered harmful or illegal.

Host4Biz is the sole arbiter of what constitutes a breach of the above rule, and reserves the right to block or delete a site at any time, for any reason, without a refund.

Host4Biz will respond to all infringement reports formatted in accordance with the Digital Millennium Copyright Act and other applicable copyright law. Infringement notices that do not comply with that act will not be considered. We will act in accordance with the DMCA when handling infringement reports.

Resource usage

If the Host4Biz systems administration team establishes that an account is using an unacceptable amount of the server's system and hardware resources, it may temporarily disable that account. If Host4Biz support considers it necessary, it may issue the client a demand to move the account concerned, giving them seven (7) days to change to a plan that will give them the right amount of resources (Host4Biz support will recommend such plans), or to order a dedicated server and move the problem account there. Otherwise the client will have to find another hosting provider. These are extreme cases, and Host4Biz will do everything it can to help the client solve their problem.
Host4Biz is the sole arbiter of whether this rule has been breached. Because of the nature of this rule, every account is considered and analysed individually.
Resource usage policy

Backups

Host4Biz makes nightly backups of its shared and reseller servers, but those backups are intended solely for Host4Biz's own administrative purposes and are in no case guaranteed. Clients are responsible for keeping copies of their data on their own computers. Host4Biz does not provide any compensation for lost or incomplete data where the backup procedures do not work correctly (even if the failure was the result of negligence on the part of Host4Biz).

Host4Biz may — but does not have to — give clients access to the most recent backup from the Plesk administration panel, allowing the client to restore their account data themselves and free of charge. Accounts larger than 10 GB are excluded from the backup schedule.

We will make every effort to provide complete and accurate backups, but we are not liable for their absence. Always keep copies of your site on your own computer. We give no guarantee as to the availability of backups.

Unwanted mail (spam)

Spam, or sending unwanted e-mail from any Host4Biz server, or giving in such a mailing a return e-mail address hosted on a Host4Biz server, is prohibited. Using spam to advertise a site hosted on the Host4Biz platform is also a breach of this rule. Host4Biz is the sole arbiter of whether this rule has been breached. Sites and hosting accounts found not to comply with our anti-spam policy will be disabled immediately without a refund.

We reserve the right to charge anyone who deliberately sends spam through our servers a penalty of 200 PLN per hour of work spent cleaning up the server and on any action to undo the effects of the spam sent.

Help us stop spam and fight it effectively. Please write to our Abuse team at [email protected] as soon as you notice a breach of our anti-spam policy.

Protecting Host4Biz support

At Host4Biz we always treat our clients with the greatest respect. In return we expect the same from you. If our staff feel they are being treated improperly, humiliated or insulted, your account may be blocked and we may ask you to move your services to another provider. In the case of abuse involving improper treatment of Host4Biz support staff, clients are given ten (10) days to find a new provider. Any refund of unused funds relating to the hosting service is considered individually in such a situation.

Protecting the servers, Host4Biz and its clients

Any attempt to undermine the reputation of, or cause damage to, Host4Biz, any server or any Host4Biz client is strictly prohibited.
Host4Biz is the sole arbiter of whether this rule has been breached. Accounts breaching this rule are subject to immediate blocking without a refund. Host4Biz will make all available information about the abuse, including clients' contact details, available to the appropriate authorities.

Failure to comply with the Terms of Service

Failure to comply fully with the above terms is grounds for suspending the account and/or deleting it (without a refund). All clients holding hosting accounts and/or servers on the Host4Biz network must comply with the above rules.
We reserve the right to delete an account without notice. If we delete an account for a breach of policy, you lose your right to a refund.
Our standard practice is to send a warning on the first breach of the rules and to delete the account on the second; a warning is not, however, required.
Host4Biz reserves the right to block and delete any site hosted on our servers that contains content Host4Biz considers, at its own discretion, unacceptable, undesirable or inadvisable.
